West Michigan and Grand Rapids Property Insurance Claims: What Property Owners Need to Know

West Michigan is one of the most storm-battered regions in our state.

If you own a home, business,  commercial building, warehouse, manufacturing facility, or commercial building in Grand Rapids, Kalamazoo, Holland, Muskegon, Battle Creek, or anywhere across West Michigan, you already know how quickly a storm, fire, or water event can cause devastating damage. What you may not know is how aggressively your insurance company will work to minimize or deny your claim once it’s filed.

Liss + Earls represents property owners — and only property owners — in insurance disputes. We have never represented an insurance company. Since 1986, our attorneys have recovered an estimated $500 million in verdicts, settlements, and insurance claim payments for policyholders, including homeowners, businesses, churches, manufacturers, apartment complexes, and commercial property owners across Michigan.

Our managing shareholder, Jason J. Liss, has spent over 30 years exclusively litigating property insurance claims for policyholders, consistently securing multimillion-dollar results for our clients. Attorneys Ann-Marie E. Earls and Joseph L. Milanowski recently secured a large settlement for a western Michigan building owner after catastrophic water damage and roof collapse.

We serve property owners throughout West Michigan. Though our primary office is in Metro Detroit, our attorneys have deep historical roots in West Michigan and frequently travel throughout the state to best serve our clients.  Here is what you need to know about protecting your rights when your insurance company fails to honor its obligations.

West Michigan's Severe Weather Exposure

West Michigan sits in one of the most active severe weather corridors in the Great Lakes region. The National Weather Service office in Grand Rapids routinely issues tornado watches and severe thunderstorm warnings for Kent, Ottawa, Muskegon, Allegan, Kalamazoo, Calhoun, and surrounding counties.

Recent years have brought devastating storms to the region. In May 2025, a line of severe storms swept across West Michigan with confirmed tornadoes in the Battle Creek area, wind gusts exceeding 80 mph in metro Grand Rapids, and trees falling onto homes and power lines from Holland to Kalamazoo. Nearly 200,000 Consumers Energy customers lost power statewide. In March 2025, storms brought possible tornadoes to Newaygo County, wind gusts above 80 mph near Gerald R. Ford International Airport, and structural damage to barns, homes, and commercial buildings across the region. In June 2024, severe thunderstorms packing winds measured between 60 and 80 mph hit the Lake Michigan shoreline from Oceana County south through Muskegon and Ottawa counties, knocking out power to 160,000 customers and triggering emergency sirens across multiple counties.

This is not occasional bad weather. This is a pattern of recurring, severe storm activity that causes significant property damage to homes, commercial buildings, warehouses, and manufacturing facilities across West Michigan every year.

The Insurance Problem in West Michigan

After a major loss, most property owners expect their insurance company to honor the policy they paid for. Too often, that does not happen. Insurance companies deploy teams of adjusters, engineers, and attorneys whose job is to minimize payouts — not to help you rebuild.

Common insurer tactics in West Michigan property claims include asserting that storm damage is really “wear and tear” or “deferred maintenance,” applying excessive depreciation to reduce replacement cost payments, classifying hail damage as “cosmetic” and invoking cosmetic damage exclusions, denying water damage claims by citing exclusions for “neglect,” “gradual deterioration,” or “maintenance,” delaying payment for months while your property deteriorates further, and demanding an Examination Under Oath to build a basis for denial.

These tactics are not unique to West Michigan, but they are especially damaging in a region where severe storms happen every year and property owners are repeatedly forced to fight for coverage they already purchased.

Types of West Michigan Property Insurance Claims We Handle

Fire and Explosion Claims

Whether it is a house fire, a commercial building fire, an industrial facility fire, or a gas explosion, we handle every stage of the claim — from initial documentation through trial if necessary. We challenge origin-and-cause determinations, defend policyholders against arson accusations, document smoke and soot damage that insurers chronically undervalue, and force insurers to pay full replacement cost.

Our firm has deep expertise in NFPA 921 fire and explosion investigation — the same standard insurers and their experts rely on to evaluate fire claims.

Water Damage Claims

Burst pipes, frozen pipes, roof leaks, fire suppression line failures, plumbing failures, and interior flooding. West Michigan’s winters produce widespread freeze-related water damage, and Lake Michigan-driven storms regularly cause roof and window failures that lead to extensive water intrusion.

Insurers aggressively deny water damage claims by arguing that the damage was caused by “gradual” processes, lack of maintenance, or pre-existing conditions. We retain independent experts, challenge these denials, and recover the full cost of remediation and repair.

Jason J. Liss recently recovered $3.25 million for a commercial property owner whose building suffered extensive water damage after a fire suppression line failed — damage the insurer significantly undervalued.

Storm, Hail, Wind, and Tornado Claims

West Michigan faces severe thunderstorms, tornadoes, straight-line winds exceeding 80 mph, and hail capable of causing significant damage to roofs, siding, windows, and structural components. The damage is real and it is expensive. Insurance companies know this — and they fight hard to avoid paying.

We retain independent engineers and roofing experts to prove the full extent of storm damage. We challenge “cosmetic damage” exclusions, excessive depreciation, and scope-of-loss disputes. We hold insurers accountable for paying what the policy requires.

Business Interruption Claims

Grand Rapids is Michigan’s second-largest metro area with a significant concentration of manufacturing, office furniture production, food processing, health care facilities, and commercial enterprises. When fire, storm, water, or explosion forces a West Michigan business to shut down — even temporarily — the financial losses compound rapidly: lost revenue, ongoing fixed expenses, employee costs, relocation expenses, and supply chain disruption.

Insurance companies routinely undervalue business interruption claims by disputing the loss period, challenging revenue projections, or denying that the business income loss is covered at all. We have extensive experience proving lost income and extra expenses, and we compel insurers to pay the full amount owed under the policy.

Jason J. Liss recently recovered $8.5 million for an automotive supplier on a business interruption claim after winning summary judgment compelling the insurer to submit to appraisal and pay penalty interest.

Denied and Underpaid Claims

If your West Michigan insurer has denied your property claim outright or offered a settlement far below the actual cost to repair or rebuild, we can help. We review every policy provision, challenge improper exclusions, retain independent experts, and pursue the full value of your claim.

Under Michigan law, if an insurer fails to pay a covered claim within 60 days of receiving satisfactory proof of loss, the policyholder may be entitled to 12% annual penalty interest under MCL 500.2006. This statute is one of the most powerful tools available to Michigan policyholders — and one of the most underused. We pursue penalty interest aggressively in every case where it applies.

Insurance Agent Negligence

Were you sold the wrong policy? Did your agent fail to include a critical endorsement? Did your coverage lapse without notice? When an insurance agent’s negligence leaves a property owner underinsured or uninsured after a loss, we hold the agent accountable and recover the difference.

Examination Under Oath

If your insurance company has demanded an Examination Under Oath, do not attend without experienced legal counsel. Insurers use EUOs strategically to build a foundation for denial. Our attorneys have represented hundreds of policyholders at examinations under oath and we know how to protect your rights during this critical stage of the claims process.

Commercial and Industrial Property Claims in West Michigan

Grand Rapids and its surrounding communities are home to a significant base of manufacturing facilities, warehouses, distribution centers, office buildings, retail centers, apartment complexes, and mixed-use commercial properties. The region’s economy includes office furniture manufacturing, automotive suppliers, food processing, health care, and logistics operations.

Commercial property losses in West Michigan are often large and complex. A single fire, roof collapse, water intrusion, or explosion at a manufacturing plant, warehouse, or multi-tenant commercial building can generate millions of dollars in property damage and business income loss. Insurance companies assign their most experienced adjusters and defense attorneys to these claims because the stakes are high.

We have recovered tens of millions of dollars on commercial and industrial property claims, including manufacturing facilities, warehouses, apartment complexes, student housing, bowling alleys, grocery stores, and mixed-use commercial structures. Our attorneys understand the complexities of commercial coverage—coinsurance penalties, blanket vs. scheduled coverage, business income calculations, extra expense provisions, and ordinance or law coverage—and we ensure that every applicable policy benefit is pursued.
